In Learning Resources, Inc. v. Trump, the Court ruled 6-3 that IEEPA does not authorize the President to impose tariffs.
The Court did not spell out refund mechanics or specific retrospective relief, but it acknowledged the tariffs are unlawful and remanded for lower courts (CIT, etc.) to handle remedies.
